The Supreme Court of Appeals on Tuesday granted former president Jacob Zuma’s appeal against the IEC ruling that had sought to bar him from being on the ballot for 29 May elections.
Zuma was convicted of contempt of court and sentenced to 15 months in jail.
However, he had argued that even though the law prevents anyone sentenced to 12 months or more from being on the ballot he has received a remission of his sentence from President Cyril Ramaphosa.
In the ruling, the Supreme Court of Appeals in Bloemfontein said: “The application for leave to appeal is granted”.
The appeal succeeds the court said.
“The decision of the Electoral Commission of 28 March 2024 in terms of which the Electoral Commission upheld Dr. Matsapola’s objection to the second applicant’s candidacy (Mr. Zuma) is set aside and substituted with the following:
‘The objection is hereby dismissed’.”
No order was made as to costs.
