The African National Congress (ANC) National Disciplinary Committee (NDC) on Friday said a written notice of its findings and disciplinary action against Ace Magashule had been sent to his residence.
The NDC has found former party secretary general Magashule guilty of misconduct and has given him seven days to say why he should not be expelled from the ANC.
The findings on Magashule’s discipline matter were first made public by ANC Secretary General Fikile Mbalula on Wednesday during a media briefing.
Magashule was charged with contravening the ANC Constitution’s Rule 25.17.12 and Rule 25.17.3 read with Rule 25.17.12 and Rule 12.1 in general and specifically with Rule 12.2.20.
On or about 3 May 2021, then secretary general, Magashule, wrote a letter to the President of the ANC Cyril Ramaphosa in which he claimed to have “suspended” the party leader while giving a false impression that he had the authority to do so.
Magashule had done so without consulting and obtaining the necessary authority to do so from National Officials, the National Working Committee, or the ANC National Executive Committee as required in terms of Rule 25.6 read together with Rule 25.70 of the ANC Constitution.
“By so doing Comrade Magashule undermined the respect for or impeded the functioning of the relevant structure or committee of the ANC,” the party said.
The ANC said Magashule further “failed, refused, or neglected to comply” with a directive of the ANC National Executive Committee duly taken at its meeting held on 8 to 10 May 2021.
The directive had ordered that Magashule apologise to the ANC President, ANC structures, and members within 48 hours after the instruction was brought to his attention.
“A letter containing such a directive was given to him personally on 12 May 2021,” the ANC said.
“His failure, refusal, or neglect to comply with the directive constitutes misconduct.”
The ANC said following its hearing and deliberations held on 23 May 2023 regarding this matter, “the NDC found Comrade Ace Magashule guilty and resolved to afford him seven days from the day he was notified of its findings to make a written submission to show cause as to why he must not be expelled as a member of the ANC”.
The ANC added: “The written notice of the NDC’s findings was duly delivered to Comrade Ace Magashule’s residence.”
