Former president Jacob Zuma whose medical parole was revoked on Wednesday by the high court in Pretoria has filed a notice of intent to appeal the ruling.
Zuma’s notice of application for leave to appeal reads in part: “Please take notice that the former president JG Zuma (cited as the 4th responded under case No 2021/45997 in the above heading and the applicant herein) hereby applies for leave to appeal”.
The 79-year-old former president moved swiftly to request leave to appeal against the whole judgment and order granted by Judge KE Matojane.
When Zuma was released on medical parole he had served two months of his 15-month sentence for contempt of court.
The court action was sparked by comments made by the then national commissioner of correctional services Arthur Fraser on SABC television admitting that he ignored the Medical Parole Advisory Board findings when he released Zuma on medical parole.
The Helen Suzman Foundation, the Democratic Alliance, and AfriForum challenged the matter in court saying the medical parole was granted unlawfully.
“The learned judge, with respect, erred and/or committed gross misdirections of fact and/or law in find that the three applicants have the requisite locus standi in judicio to bring the application,” reads the court document filed by Zuma.
The notice of appeal ensures that Zuma can spend Christmas with family and friends.
