SIU To Appeal High Court Ruling Preventing Probe Into Telkom Affairs

The Special Investigating Unit (SIU) on Monday announced that it has filed papers to apply for leave to appeal the decision of the High Court of South Africa, Gauteng Division Pretoria, relating to the Unit’s intended investigation into the affairs of Telkom. 

Last month, the High Court ruled that Proclamation R49 of 2022 authorising the SIU to investigate allegations of serious maladministration, malpractice, and possible corruption in the affairs of Telkom was declared unconstitutional, invalid, and of no force or effect.

The High Court found that Telkom is not a State Institution and therefore, the SIU could not investigate allegations of serious maladministration, malpractice, and possible corruption in the affairs of Telkom.

On Monday the Kaizer Kganyago SIU Spokesperson said: “After consulting with our legal team, the SIU is of the opinion that there is reason for an appeal”.

The SIU added: “The Court needs to give a fuller picture of what constitutes a State institution as this can set a legal precedent on which institutions the SIU can exercise its powers.

“It is important that the issue of the “state institution” must be decided and settled.

“If this is not clarified, it may create an unwelcome precedent that some public institutions may inadvertently be shielded from investigation by the SIU.”

Abrahams will manage the Digital Platform business for Telkom within its technology function. His responsibilities will include driving digital strategy, as well as identifying and implementing innovative technologies to develop opportunities for the Group.

Abrahams is well equipped to drive Telkom’s digital business, having worked in leadership and strategy roles in the digital content, music, broadcasting, television and online sectors.

Green shoots in the form of revenue growth have emerged at Telkom, where strong first quarter results were released on Monday.

With such encouraging numbers, Telkom can expect to be wooed by more suitors. Asked to comment on Telkom’s enhanced attractiveness, CEO Serame Taukobong smiled and said: “My brother, you make me feel like Queen Nandi in Shaka iLembe.”..
